Undocumented immigrant nabbed for sex crimes
An alleged gang member who was deported from the country for reported sex crimes has been apprehended again in a Pennsylvania town. The man, age 25, is now facing federal charges after he was spotted by a police officer in a local big-box store, according to official reports. The defendant in this case is a known member of a relatively dangerous gang, Surenos 13. Authorities report that the officer first spotted the man while shopping in Wal-mart in Chester County while off duty. Civilians and children were in the store, so the officer decided to postpone arresting the man, as he feared that a dangerous altercation might ensue. A subsequent investigation by the Department of Homeland Security and Chester County authorities led to the defendant’s arrest. Official reports show that the man is again in the country illegally, even though he was deported in accordance with special laws about felonies and sex crimes. If the man is convicted of again violating Megan’s Law provisions, he could face an extended stint in state and federal prison, followed by another deportation to his home country of Mexico. Even though he was deported in 2012, authorities say the man made his way back into the U.S. through unknown channels. The defendant’s criminal history in this case is relevant; he had previously been convicted of kidnapping, rape and involuntary deviant sexual intercourse. The man was paroled from state prison after spending about seven years in custody. He was deported to Mexico in 2012 after being released from jail. Even under the most lenient interpretation of immigration laws, convicted felons who are also undocumented are among the most likely candidates for formal deportation. The complexities of this case and others involving immigration concerns are best addressed by qualified criminal defense attorneys. These professionals can help defendants learn more about their rights and responsibilities in the courtroom.
